Welcome to Radio Navigator. These Terms of Service ("Terms") govern your access to and use of Radio Navigator (https://radionavigator.app), operated by RHBA, Lytchett House, 13 Freeland Park, Wareham Road, Poole, Dorset, BH16 6FA ("we," "us," "our," or "Company").
PLEASE READ THESE TERMS CAREFULLY.
By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
IMPORTANT FOR CONSUMERS: If you are a consumer (an individual acting outside your trade, business, craft, or profession), you have statutory rights under consumer protection laws that cannot be excluded or limited.
Note: These Terms are tailored primarily for UK and EU/EEA users. As we expand globally, we will update these Terms to include additional regional protections.
1. Definitions
- "Service" - The Radio Navigator web application, including all features and functionality
- "User," "you," "your" - Any individual or entity using the Service
- "Consumer" - An individual acting for purposes outside their trade, business, craft, or profession
- "Business User" - A User acting for business purposes
- "Account" - Your registered account with the Service
- "Subscription" - A paid plan providing access to Pro features
- "Free Tier" - Limited functionality available without a Subscription
- "Pro Tier" - Enhanced functionality available with a Subscription
- "Free Trial" - A limited-duration period (currently seven days) during which a registered Account may access a restricted selection of Pro Tier tools at no charge and with no payment method required. The Free Trial does not auto-convert to a paid Subscription and never results in a charge. At the end of the Free Trial the Account simply reverts to the Free Tier unless you choose to subscribe.
- "Fixed-Term Package" - A one-time purchase granting full Pro Tier access for a fixed duration stated at checkout, after which access expires. Fixed-Term Packages do not auto-renew.
2. Description of Service
Radio Navigator is a radio navigation simulator designed to help pilots and aviation students practise using navigation instruments.
The Service provides simulated navigation scenarios for personal practice only.
The Service is a web-based application that requires an active internet connection to access and use. No offline functionality is provided.
Communications from Us
By creating an account you agree that we may send you service messages by email about your account, your subscription or free trial, security and account issues, and material changes to these Terms or our Privacy Policy. These are part of providing the Service and cannot be opted out of while your account is open, other than by closing your account. Billing and payment confirmations are sent by our payment processor, Paddle.
Marketing email is separate and entirely optional. We send it only if you opt in, and you can withdraw at any time through Email preferences in your account settings or the unsubscribe link in any email we send. Withdrawing has no effect on your account, your subscription, or your access to the Service. How we record that choice is set out in our Privacy Policy.
3. IMPORTANT DISCLAIMER - Recreational Purposes Only
3.1 Not for Real-World Navigation
Radio Navigator is a simulation tool for personal practice and must NEVER be used for:
- Actual flight navigation
- Real-world aviation operations
- Flight planning for actual flights
- Training towards a licence or rating
- Any operational aviation decision-making
3.2 Not Aviation Training
Certain features of the Service are labelled "Trainer" (for example, "Intercept Trainer" and "Holding Trainer"). This terminology refers solely to the structured, scenario-based format of those features. It does not imply, represent, or constitute aviation training of any kind in any legal, regulatory, or professional sense.
Use of ANY feature of this app does not, under any circumstances:
- Count towards or replace training required for any pilot licence, rating, or certificate
- Satisfy any regulatory training requirement imposed by the CAA, FAA, EASA, or any other aviation authority
- Qualify as approved ground school, simulator training, or instruction from a qualified flight instructor
- Constitute an endorsement of any skill or competency for real-world flight operations
- Form part of, or constitute a record of, any flight lesson, ground training session, simulator lesson, flight test, skill test, proficiency check, licence revalidation, or debrief of a third party. Any such use is a visual aid only and is not part of the lesson, test or check itself
The Service is provided for personal practice only.
3.3 No Reliance by Third Parties
The Service is not intended to be, and must not be, relied upon by any person who is not a registered User of the Service. We do not owe, and expressly disclaim, any duty of care to any student, trainee, cadet, candidate, examinee, flight school, approved training organisation, declared training organisation, flight training organisation, employer, regulatory or licensing authority, insurer, or other third party in respect of their exposure to, or reliance on, any output, content, calculation, display, or behaviour of the Service.
4. Eligibility and Age Requirements
4.1 Age Requirement
You must be at least 18 years of age to use the Service in the UK and Europe. By using the Service, you represent that you meet this age requirement.
United States Users: If you are in the US, you must be at least 13 years of age. Users between 13 and 18 should have parental or guardian consent.
5. Personal Use Only
5.1 General Rule
The Service is made available to you under the right to access set out in Section 8.2, for your personal, non-commercial use only. You may use the Service for your own personal practice, but you must not use it to provide training or instruction to others, to operate a training program, to debrief, or for any commercial or revenue-generating purpose without our prior written permission.
5.2 Instructor and Examiner Limited Use
Where we grant prior written permission for instructor, examiner, or similar professional use (including use of the Service as a visual aid), that permission is subject to the following terms, which apply in addition to, and do not replace, the rest of these Terms:
- The permission is personal to the named recipient, non-transferable, and revocable by us at any time by written notice (including by email)
- The Service may be used only as a visual aid or illustration tool; it must not be presented to any student, candidate, or third party as authoritative, certified, approved, or as a source that can be relied upon without independent verification
- The Service is not, and must not be held out as, aviation training, examination content, or any part of a flight test, skill test, proficiency check, or licence revalidation (see Section 3.2)
- The recipient or user remains solely responsible, in both a professional and personal capacity, for the correctness of anything shown to, or discussed with, a student, trainee, cadet, candidate or other third party
- Before using the Service in the presence of, or with reference to, any student, trainee, cadet, candidate, or other third party, the recipient must expressly inform that person (a) that the Service is a simulator for personal practice only, (b) that it is not training, examination, or assessment material and does not form part of any lesson, test, check, or record, and (c) that nothing shown by the Service may be relied upon as authoritative, accurate, or as a record of any kind
- The recipient must not include any output, screenshot, recording, score, or result from the Service in any formal training record, logbook entry, test report, examination document, or licensing submission
- The recipient warrants that their use of the Service with any third party complies with all applicable aviation regulations and with the rules of any approved training organisation, declared training organisation, flight training organisation, employer, or regulatory or licensing authority under whose authority they operate or to whom they are accountable
- All disclaimers, warranty exclusions, liability caps, and indemnities in these Terms (including Sections 3, 9, 10, and 11) continue to apply in full to the recipient and to the recipient's use of the Service with third parties
- The recipient must hold a current Pro Tier Subscription for the duration of such use, unless we agree otherwise in writing
Written permission under this Section is only valid if given by an email sent from an @radionavigator.app address by RHBA, and must expressly identify the named recipient, the scope of permitted use, and any duration or conditions. Nothing else constitutes written permission, including (without limitation) verbal statements, telephone calls, messages on social media, chat, or third-party platforms, emails from any other address, discount codes, promotional offers, pricing arrangements, or prior conduct. Nothing in this Section 5.2 grants any licence, approval, endorsement, or accreditation.
6. Subscriptions and Payments
6.1 Free Tier
The Free Tier provides limited access at no cost. Features may be changed without notice.
6.2 Pro Tier Subscription
The Pro Tier requires a paid Subscription providing access to advanced navigation instruments and extended functionality.
6.3 Payment Processing
All payments are processed through Paddle (paddle.com). By subscribing, you will be required to agree to their Terms of Service and Privacy Policy.
6.4 Account Creation via Checkout
When you purchase a Pro subscription:
- An account will be automatically created using your payment email address
- You consent to this account creation by completing the checkout process
- This account allows you to access Pro features and manage your subscription
- You can set a password later via the "Set Password" prompt in your account settings
6.5 Automatic Renewal
IMPORTANT: Your Subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
- Monthly Pro subscriptions - Renew every month on your billing date
- Annual Pro subscriptions - Renew every twelve months on your billing date
- Instructor Monthly subscriptions - Renew every month on your billing date
- Instructor Annual subscriptions - Renew every twelve months on your billing date
Fixed-Term Packages (IR Package, CPL/IR Package, Full fATPL Package, and Instructor 12-Month) are one-time purchases and do not auto-renew. See Section 6.11.
When you subscribe to a recurring Subscription at checkout, the first payment is taken immediately and recurring payments then continue on the cycle above until you cancel. Subscriptions do not begin with a free trial period and there is no deferred first charge.
6.6 Free Trial
WHAT YOU ARE AGREEING TO: The Free Trial is completely free and requires no payment method. We do not collect card or payment details to start it, we never charge you for it, and it does not convert into a paid Subscription. There is nothing to cancel.
- Duration and access: The Free Trial currently lasts seven (7) days from the time you create your Account. During the trial you have access to a restricted selection of Pro Tier tools (currently the Just Fly, Intercept, and Hold Visualiser tools). The trial does not include the interactive lessons or other Pro Tier features, which require a paid Subscription or Fixed-Term Package.
- No payment method: No card or other payment method is collected to start or run the Free Trial. No charge of any kind is taken during or after the trial.
- What happens at the end: At the end of the seven-day period your Account automatically reverts to the Free Tier. Nothing converts to a paid plan and no payment is taken. If you wish to continue using Pro Tier features you may subscribe or purchase a Fixed-Term Package at any time, before or after the trial ends.
- Eligibility: The Free Trial is limited to one Free Trial per person. We maintain a ledger to enforce this limit, which is retained even if you later delete your Account, so that a deleted-and-recreated Account cannot obtain a second trial. We may decline to offer, or terminate, a Free Trial where we reasonably suspect abuse of this limit. This processing is described in our Privacy Policy.
- Changes to the trial: We may change the duration, content, or eligibility of the Free Trial for future sign-ups. Changes do not affect a Free Trial that has already started.
- Statutory rights: The Free Trial involves no payment, so the refund and withdrawal provisions in Section 6.7 do not apply to it. Those provisions apply to paid Subscriptions and Fixed-Term Packages.
United States users (FTC ROSCA Rule, California ARL, New York GBL §527-a): Recurring Subscriptions (monthly or annual) are charged immediately at checkout and then continue to be charged automatically on the recurring billing cycle shown at checkout until you cancel. The recurring charge amount and billing frequency are shown to you at checkout, and a confirmation containing the same information is emailed to you by Paddle. You may cancel at any time, online and without speaking to anyone, through any of the methods in Section 6.9. These Terms together with the disclosures shown at the Paddle checkout constitute your express informed consent to recurring billing. Fixed-Term Packages and the Free Trial do not auto-renew and are not charged on a recurring basis.
6.7 Refunds and Right of Withdrawal
If you are a UK or EU/EEA consumer, you have a statutory 14-day right to withdraw from your subscription. Radio Navigator Pro is supplied to you as both a digital service (the interactive simulator, trainers and account features) and as digital content (the lessons, courses, trainers), and these Terms apply to both elements of the supply together.
The 14-day cancellation period runs from the day you complete your purchase at checkout (whether a recurring Subscription or a Fixed-Term Package). The Free Trial is free and involves no payment, so the right of withdrawal does not apply to it.
By accepting these Terms at checkout you (a) expressly request that we begin supplying Radio Navigator Pro to you immediately, without waiting for the 14-day cancellation period to expire, and (b) give your express consent and acknowledgement that, once you have accessed Pro features, you thereby lose your right of withdrawal. Pro features and Pro content are delivered to you immediately on checkout completion, so performance of the contract begins at that point. Once you have accessed any Pro feature, the right of withdrawal is extinguished and no refund is available under it.
To exercise the right of withdrawal before you have accessed Pro features, email accounts@radionavigator.app indicating that you wish to invoke your 14-day right of withdrawal. A clear statement in writing is sufficient; no specific form is required. Where this right is validly exercised, we will refund the full subscription price paid for the current term to your original payment method within 14 days of receiving your notice.
Where any other refund is due (for example, where a charge has been taken in error), we will refund you using the same payment method you used for the original payment, unless you expressly agree otherwise.
For refund requests beyond statutory rights, please contact accounts@radionavigator.app. All refund requests are handled on a case-by-case basis.
6.8 Device Limits
Each Pro Subscription is licensed for use by a single individual on up to 2 devices simultaneously. If you sign in on a third device, the oldest active session will be automatically signed out. Account sharing is prohibited under Section 7 of these Terms, and repeated violations may result in account suspension or termination under Section 13.
6.9 How to Cancel
You may cancel your Subscription anytime by:
- Account Settings - Log in and navigate to Subscription settings
- Email - Send cancellation request to support@radionavigator.app
- Paddle Portal - Use subscription management link (sent in confirmation email)
Upon cancellation, you retain access to Pro features until the end of your current billing period.
6.10 Instructor Licence
The Instructor Licence is a separate subscription tier available only to instructors who have received prior written permission from us. Purchasing an Instructor subscription does not, by itself, constitute written permission or authorisation to provide training or instruction using the Service.
Using the Service for instruction, commercial, or revenue-generating purposes without our prior written consent, regardless of which subscription tier is purchased, is a breach of Section 5 and may result in account termination under Section 13.
6.11 Fixed-Term Packages
Fixed-Term Packages (including the IR Package, CPL/IR Package, Full fATPL Package, and Instructor 12-Month) are one-time purchases granting access for a defined period stated at checkout. These packages do not auto-renew and no further charges will be taken after the initial purchase. Access ends automatically on the stated expiry date. To retain access beyond expiry you must purchase a new subscription or package.
For the avoidance of doubt, the auto-renewal terms in Section 6.5 apply only to recurring Subscriptions (Pro, Pro yearly, Instructor Monthly, Instructor Annual) and do not apply to Fixed-Term Packages.
7. Acceptable Use
You agree to use the Service only for lawful purposes. You agree not to:
- Use the Service for real-world navigation, flight operations, or safety-critical decisions
- Attempt to access, interfere with, or disrupt the Service, its security features, or the servers and networks that provide it
- Reverse engineer, decompile, scrape, data-mine, or otherwise misuse the Service
- Share accounts, resell access, or allow any other person to use your Account
- Upload, submit, or transmit any content that is unlawful, infringing, defamatory, malicious, or that contains viruses, worms, or other harmful code
- Impersonate any other person, including other users, RHBA staff, or any third party
- Use the Service to send unsolicited communications, spam, or bulk messages
- Violate any applicable law, regulation, or third-party right in connection with your use of the Service
8. Intellectual Property and Service Access
8.1 Ownership
All rights, title, and interest in and to the Service, including but not limited to:
- Software code, algorithms, and architecture
- User interface design and graphics
- Trademarks, service marks, and logos (including "Radio Navigator")
- Navigation data, simulation models, and proprietary calculations
- Documentation, tutorials, and educational content
are and will remain the exclusive property of RHBA and its licensors. These Terms do not grant you any ownership rights to the Service or its content.
8.2 Right to Access and Use the Service
The Service is a hosted web application. All software, code, infrastructure, databases, and content are retained by us at all times; nothing is downloaded, installed, sold, or licensed to you. Subject to these Terms, we grant you a personal, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the Service over the internet for your own personal, non-commercial purposes, for so long as your Account is in good standing and, for Pro features, your Subscription or Fixed-Term Package is active. During a Free Trial under Section 6.6 this right extends only to the restricted set of Pro Tier tools made available for the trial.
This right is conditional on your compliance with these Terms and terminates automatically on cancellation, suspension, or termination of your Account or Subscription. This right does not include any right to:
- Copy, modify, or create derivative works from the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices
- Use any automated system (including robots, scrapers, or spiders) to access the Service
- Frame, mirror, or republish any part of the Service
- Sublicense, sell, rent, lease, or otherwise transfer your access to the Service
All rights not expressly granted in these Terms are reserved by RHBA.
8.3 Trademarks
"Radio Navigator" and related logos are trademarks or registered trademarks of RHBA. You may not use these marks without our prior written permission. All other trademarks referenced in the Service are the property of their respective owners.
8.4 User-Generated Content
If you provide feedback, suggestions, or other input regarding the Service ("Feedback"), you grant us a worldwide, perpetual, irrevocable, royalty-free licence to use, modify, and incorporate such Feedback into the Service without attribution or compensation. This licence does not extend to any personal data contained in your Feedback; any such personal data will be handled in accordance with our Privacy Policy.
8.5 Copyright Infringement
We respect intellectual property rights. If you believe any content on the Service infringes your copyright, please contact us at legal@radionavigator.app with details of the alleged infringement.
9. Disclaimer of Warranties and Data Loss
9.1 "As Is" Basis
The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties that the Service will be uninterrupted, secure, or error-free
- Warranties regarding the accuracy, reliability, or completeness of any content, data, or calculations
- Warranties that defects will be corrected or that the Service is free of viruses or harmful components
9.2 No Liability for Data Loss
WE ARE NOT RESPONSIBLE FOR ANY LOSS, CORRUPTION, OR UNAVAILABILITY OF YOUR DATA, ACCOUNT INFORMATION, OR PROGRESS.
You acknowledge and agree that:
- The Service does not provide backup or data recovery services
- We make no guarantees regarding data retention or availability
- Your data may be lost due to technical failures, service interruptions, account termination, or other causes
- You are solely responsible for maintaining your own copies of any data or information you wish to preserve
- We may delete inactive accounts or data after prolonged periods of inactivity without notice
YOU ACCEPT ALL RISKS ASSOCIATED WITH DATA STORAGE AND AGREE THAT WE HAVE NO LIABILITY FOR ANY DATA LOSS, REGARDLESS OF CAUSE.
9.3 Service Availability
We do not guarantee continuous, uninterrupted, or secure access to the Service. The Service may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any feature or the entire Service at any time without liability.
9.4 Device and Browser Compatibility
While we have tested the Service on as many browsers and devices as possible, we cannot guarantee that it will function correctly on all devices, browsers, or operating systems. If you are unable to access or use the Service due to a compatibility issue, please contact us at support@radionavigator.app to request a refund.
9.5 Simulation Accuracy
The Service provides simulated navigation scenarios for practice purposes only. We make no representations or warranties regarding the accuracy, realism, or suitability of any simulation, calculation, or navigation data. You acknowledge that simulation results may differ from real-world conditions and must never be relied upon for actual navigation or flight operations.
Consumer Rights: If you are a consumer in the UK or EU/EEA, your statutory rights under consumer protection laws are not affected by these disclaimers to the extent they cannot be excluded by law.
10. Limitation of Liability
Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot, under applicable law, be limited or excluded. All other provisions of this Section 10 are subject to this paragraph.
10.0 Risk Allocation
You acknowledge that the restrictions on use in Section 3 (Recreational Purposes Only) and Section 5 (Personal Use Only), together with the warranty disclaimers in Section 9, the liability limits in this Section 10, and the indemnity in Section 11, together allocate the risks of using the Service between you and us. These provisions are a fundamental part of the commercial basis on which the Service is offered at its current price, and apply equally to free access (including the Free Trial under Section 6.6 and the Free Tier), and we would not make the Service available on these terms without them.
10.1 Exclusion of Indirect Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, business opportunities, or anticipated savings
- Loss of data, information, or content (including training progress or account data)
- Loss of goodwill or reputation
- Business interruption or lost productivity
- Costs of procurement of substitute services
This exclusion applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and whether or not we were advised of the possibility of such damages.
10.2 Specific Exclusions
We are not liable for losses arising from:
- Reliance on the Service for actual navigation, flight operations, or safety-critical decisions
- Use of the Service contrary to these Terms or applicable law
- Unauthorised access to your account or security breaches attributable to your failure to safeguard credentials
- Third-party services (including Clerk, Paddle, or Vercel)
- Service interruptions, data loss, or technical failures
- Your failure to comply with these Terms or applicable aviation regulations
- Force majeure events or circumstances beyond our reasonable control
10.3 Liability Cap
Our total aggregate liability for all claims arising from or related to your use of the Service shall not exceed:
- For all users (whether Consumer Users or Business Users): the lesser of (a) the total amount you paid for the Service in the three months preceding the claim, or (b) £50 GBP
This cap applies in aggregate to all claims, regardless of the number of events or causes of action.
Consumer Rights: If you are a consumer in the UK or EU/EEA, your statutory rights under consumer protection laws are not affected by these limitations to the extent they cannot be excluded or limited by law.
11. Indemnification
11.1 Indemnity Obligation
To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless RHBA, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal costs) arising out of or related to:
- Your use or misuse of the Service
- Your breach of these Terms or violation of any law or regulation
- Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
- Use of the Service for actual navigation, flight operations, training
- Any use of the Service to instruct, examine, brief, debrief, or otherwise present content to a student, trainee, cadet, candidate, or other third party (whether or not under a permission granted under Section 5.2), including any claim brought by that third party, their employer, flight school, approved training organisation, declared training organisation, flight training organisation, insurer (including by way of subrogation), or any regulatory or licensing authority, that information shown by, or conduct associated with, the Service was incorrect, incomplete, misleading, or inadequate for any training, examination, assessment, revalidation, or licensing purpose
- Any damage caused to third parties by your use of the Service
- Unauthorised access to your account resulting from your failure to maintain account security
- Any content, feedback, or information you submit to the Service
11.2 Defence and Settlement
We reserve the right, at our own expense, to assume the exclusive defence and control of any matter subject to indemnification by you. You agree to cooperate with our defence of such claims and not to settle any claim without our prior written consent.
Consumer Rights: If you are a consumer in the UK or EU/EEA, this indemnity is limited to the extent permitted by law and does not affect your statutory consumer rights.
12. Third-Party Services
We use third-party service providers for authentication, payments, hosting, security, and related functions. A full list of these providers, their roles, and the legal bases on which they process your personal data is set out in our Privacy Policy. Your use of the Service is subject to those providers' own terms and privacy policies. We are not responsible for third-party practices.
13. Account Suspension and Termination
13.1 Termination by You
You may terminate your Account at any time by:
- Accessing your Account settings and selecting "Delete Account"
- Contacting support@radionavigator.app with your termination request
Upon termination, your access to the Service will be immediately revoked. If you have an active Subscription, it will be cancelled and you may be entitled to a pro-rated refund at our discretion.
13.2 Termination and Suspension by Us
WE RESERVE THE RIGHT TO SUSPEND, RESTRICT, OR TERMINATE YOUR ACCOUNT AND ACCESS TO THE SERVICE, WITH OR WITHOUT NOTICE, FOR ANY OF THE FOLLOWING REASONS:
- Breach of Terms: Any violation of these Terms, including but not limited to prohibited uses outlined in Section 7
- Fraudulent Activity: Suspected fraud, payment disputes, chargebacks, or use of stolen payment methods
- Safety Concerns: Use of the Service in a manner that poses safety risks or violates aviation regulations
- Abusive Behaviour: Harassment, threats, or abusive conduct toward our staff, other users, or third parties
- Account Sharing: Sharing login credentials or allowing unauthorised access to your Account
- Technical Abuse: Attempting to hack, reverse engineer, scrape, or otherwise compromise the Service's security or performance
- Commercial Misuse: Using the Service for unauthorised commercial purposes or reselling access
- Payment Failure: Failure to pay subscription fees or repeated payment failures
- Legal Compliance: Required by law, court order, or government authority
- Inactivity: Prolonged account inactivity without a subscription (typically 12+ months with no login, and no active subscription)
- Our Discretion: Any other reason we deem necessary to protect the Service, our users, or our business interests
13.3 Immediate Suspension
We may immediately suspend your access without prior notice if we believe, in our sole discretion, that your continued access poses an immediate risk to the Service, our systems, other users, or violates applicable law. During suspension, you will not be able to access your Account or any Pro features.
13.4 Effect of Termination
Upon termination or suspension:
- Your right to access and use the Service immediately ceases
- We may delete your Account data, progress, and any associated content
- We have no obligation to retain, provide, or restore any of your data
- Outstanding fees remain due and payable
- Sections of these Terms that by their nature should survive termination will remain in effect (including Sections 8, 9, 10, 11, and 15)
13.5 No Refund on Termination for Cause
If we terminate or suspend your Account due to your breach of these Terms or for cause, you will not be entitled to any refund of Subscription fees. Refunds for suspensions or terminations are at our sole discretion.
13.6 Right to Refuse Service
We reserve the right to refuse service, deny Account creation, or reject Subscription applications to anyone for any lawful reason, including if we believe the applicant has previously violated these Terms or poses a risk to the Service or other users.
Consumer Rights: If you are a consumer in the UK or EU/EEA, your statutory consumer rights are not affected by these termination provisions to the extent they cannot be excluded by law. You may be entitled to refunds or remedies under consumer protection legislation depending on the circumstances of termination.
14. Changes to Terms and Service
We may update these Terms or our Privacy Policy from time to time, and may change, suspend, or discontinue features. Where we make material changes to these Terms or our Privacy Policy, you will be asked to actively re-acknowledge the updated documents in-app before continuing to use the Service, and the date and version of your re-acknowledgement will be recorded in your account record. For non-material changes, continued use after the change constitutes acceptance. If you disagree with any change, stop using the Service and cancel any Subscription.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms are governed by the laws of England and Wales.
15.2 Informal Resolution
Before initiating any formal proceedings, you agree to first contact us at support@radionavigator.app and attempt to resolve the dispute informally for at least 30 days. Most concerns can be resolved quickly through direct communication.
15.3 Jurisdiction
Business Users agree to the exclusive jurisdiction of the courts of England and Wales. Consumers may bring claims in the courts of their country of residence and retain mandatory consumer protections.
16. General Provisions
- Severability: if a provision is unenforceable, the remainder stays in effect.
- Assignment: you may not assign these Terms without our consent; we may assign these Terms to an affiliate, acquirer, or successor, and where you are a consumer we will give you reasonable advance notice of any such assignment before it takes effect.
- Force majeure: we are not liable for delays or failure caused by events beyond our reasonable control.
- Entire agreement: these Terms, together with our Privacy Policy, constitute the entire agreement between you and RHBA regarding the Service and supersede all prior agreements, understandings, and communications.
- Third-party rights: a person who is not a party to these Terms has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms. This does not affect any right or remedy of a third party that exists, or is available, apart from that Act.
- Accessibility: we aim to meet the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA as a target for the Service. If you encounter an accessibility barrier, please contact support@radionavigator.app and we will do our best to provide the information or functionality you need in an alternative accessible format.
